Question by Jeff T: What would be a good topic for an advanced bankruptcy thesis to research and write about for law school?
I have to research and write a thesis on a bankruptcy topic for a law school class and am trying to decide a good topic. It has to be a thesis, not a book report-type paper, so don’t suggest I write about the GM bankruptcy or something. I am looking for a issue that is current, preferably within a year or so, but at least post-BAPCPA, that is still not resolved or at least has inconsistent court opinions or is a piece of legislation in the works. I’d like to stick with issues concerning either chapters 7, 11, or 13. Any links to articles or other materials you have seen that discuss the topic you suggest would be great too. Thanks for the help!
In response to Ranger44, I am not desperate, and yes I know most answers given will be unintelligent. I have several ideas already but I’m just beginning this process and figured I’d throw the question out there and maybe someone will offer something I hadn’t thought of. So it’s not despair, it’s good research – using many resources where you may find a source you otherwise wouldn’t have thought of. Yes I know this is a stretch on Answers, but who knows, some attorney may read this who has litigated cases in several districts and has found inconsistencies in the judgments or has come across a recurring issue regarding the debtors or creditors that they represent. Your suggestion is rather useless, it can’t be developed citing case law really, yes bankruptcy does what is intended to do, granting discharge or providing a forum to repay debts. Is it a perfect system, no! But it does grant discharge unlike other systems such as a debtor prison, so it obviously does, imperfectly, work.

Since this is a thesis you must make an assertion and then support it. Correct?
Since it is law school, the thesis must pertain to how bankruptcy law works?
Well…here is what I’ve pulled off the top of my head.
The economic purpose of bankruptcy is to allow people to start businesses and take economic risks without fear of losing everything they own and without fear of having to spend years if not decades repaying old debts. Would you start a business if you stand to risk all of your assets and you’d be stuck paying back business debts for a protracted period of time? The answer is, you may not.
So, do bankruptcy laws do what it what they were intended to do?

It all depends on what your position is on cosmetic surgery.
For example, if you were for it, your thesis could could be something like, “There are many arguments that can be made to defend cosmetic surgery, such as ______, _______, ______, and ______.” Tweak it so it fits you and whatever you’re supporting, and introduces the main idea of the paper in a clear, concise manner.
Some points you could make if you’re pro cosmetic surgery:
+ Natural beauty is overrated because those of us born with naturally appealing looks were just given good genes at birth. It’s all a matter of luck.
+ It can be a self-esteem booster.
+ It’s normal to want to be more aesthetically pleasing. Changing what you look like doesn’t change who you are on the inside, and while inner beauty is more important, one could pursue both inner beauty and outer beauty.
+ Some things can’t be changed or prevented through diet and exercise, so it’s not like getting surgery to change a too-big chest or disproportionate nose is being lazy.
+ Surgeons usually do mental screenings to ensure patients aren’t mentally unstable.
+ Usually, the idea of cosmetic surgery is to balance out the natural features, and not to change all of them completely.
+ It’s a matter of personal choice. If one is well-informed about the risks and have realistic expectations, a good surgeon, and the money to pay for it, that’s up to him or her. There will be Cindy Jacksons, and there will be Jocelyn Wildensteins. The difference is in taste and awareness.
Some points you could make against it:
+ One should only change their features if there’s something wrong, like a cleft lip and palate, or getting a breast implant after a mastectomy due to cancer. So in a way, it’s almost insulting when someone who looks fine wants to change how they look.
+ Plastic people are shallow, fake, and insecure.
+ Money spent on plastic surgery is better off going towards causes like research, education, feeding the hungry, etc.
+ Jocelyn Wildenstein and Joan Rivers… gross.
+ Cosmetic surgery is still real surgery, even if it is elective. It can lead to infections, and even death.
Pick your points and elaborate.
You could also have a bit of counter-arguing going on, such as “It is a common belief that [opposing side’s point]. However, [make a point coming from your side that proves the other side wrong].
